In a much-awaited move, the Department of Energy ("DOE") has issued another solicitation under its Section 1705 Loan Guarantee Program (the ... show more In a much-awaited move, the Department of Energy ("DOE") has issued another solicitation under its Section 1705 Loan Guarantee Program (the "Section 1705 Program"). Unlike other solicitations under the American Recovery and Reinvestment Act ("ARRA"), this solicitation is not aimed at the borrowers or the developers — it is open to lenders only and invites them to apply for a partial, risk-sharing loan guarantee under the Department of Energy's ("DOE") Section 1705 Loan Guarantee Program for Commercial Technology Renewable Energy Generation Projects. This solicitation provides up to $750,000,000 of the $3.95 billion made available to support debt financing of U.S. renewable projects. The solicitation appears to be DOE's answer to the inability of eligible borrowers to meet the cost-share requirement.

This program, which was created by the American Recovery and Reinvestment Act effective as of February 17, 2009, provides a 30 percent federal income tax credit for investment in property which "re-equips, expands, or establishes a manufacturing facility" that produces renewable energy property.

SPP hopes that the reformed procedures will help the transmission provider more effectively process the approximately 255 pending interconnection requests in the queue that account for 57,000 megawatts ("MW") of generation. SPP now joins other independent system operators that have undergone interconnection queue reform—the Midwest ISO and California ISO revised their interconnection procedures in 2008.

The long-awaited solicitations provide crucial details regarding the application process for both the legacy loan guarantee program for innovative projects (referred to as the section 1703 program) and a newly established program for projects using proven technologies (referred to as the section 1705 program).

In the ROD, BPA provided a detailed rationale for charging wind generators a Wind Integration Rate ("WI Rate"). Although the final rate of approximately $5.70/megawatt-hour ("MWh") for "wind integration" or "wind balancing" services is less than half the rate that BPA initially proposed ($12/MWh), it is a signal to the wind industry that transmission providers may change course as they react to increasing amounts of wind being integrated into the grid.

The Policy Statement also establishes an important jurisdictional line by providing that, although FERC's rate recovery authority is limited by section 205 of the Federal Power Act, FERC is vested with the authority to adopt smart grid standards applicable to all electric power facilities—even those at the local distribution level and those directly used by retail consumers.

DOE wants leading scientists and engineers from universities, private industry, and government to collaborate in developing a thriving domestic biofuels industry . The collaborations will allow different sectors in the biofuels industry to work together on new technologies for producing advanced biofuels that can be brought to market without requiring major modifications to the existing fueling infrastructure. Examples of advanced biofuels include green aviation fuels, green gasoline, and green diesel from a variety of biomass feedstocks.
